These Terms and Conditions apply to the use of the RoosterKracht
scheduling software and services, offered by Farfetched Software
(a trade name of Lucas Ammerlaan), based in the Netherlands.
1. Definitions
"Service": The RoosterKracht software and all associated functionalities.
"User": Any individual or legal entity using the Service.
"Employer": A user who adds and manages employees through the Service.
"Employee": A user added to the Service by an employer.
2. Applicability
These terms apply to all use of the Service and all agreements between
Farfetched Software and Users. By using the Service, the User agrees to these terms.
3. Use of the Service
Users must provide accurate and up-to-date information during registration.
Use of the Service for illegal or inappropriate purposes is prohibited.
Account access is personal. Login details may not be shared.
Employers are responsible for ensuring that all employees added to their account comply with these Terms and Conditions.
By adding an employee to the Service, the Employer confirms that the employee has been informed of and agrees to be bound by these terms.
4. Subscriptions and Payment
RoosterKracht is offered in different subscription plans as displayed on the website (roosterkracht.eu).
Farfetched Software reserves the right to adjust prices. Changes will be communicated at least 30 days in advance.
Payments are made in advance on a monthly basis unless otherwise agreed upon.
5. Duration and Termination
Subscriptions are open-ended and can be canceled monthly.
Upon cancellation, the account will be deactivated and personal data will be deleted in accordance with the privacy policy.
>Farfetched Software may suspend or terminate access to the Service in case of misuse or violation of these terms.
6. Intellectual Property
All rights to the software, source code, trademarks, and content of the Service are held by Lucas Ammerlaan under the trade name Farfetched Software.
Users are granted a limited, non-exclusive, and non-transferable right to use the Service.
7. Liability
The Service is provided "as is".
Farfetched Software is not liable for indirect damage, data loss, or loss of profit.
Total liability is limited to the amount paid for subscription fees in the last three calander months.
8. Privacy
Farfetched Software processes personal data in accordance with the privacy policy.
9. Force Majeure
Farfetched Software is not obliged to fulfill obligations if prevented by circumstances beyond its control (e.g., technical failures, internet issues, government measures).
10. Governing Law and Disputes
These terms are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
